Introduction
These Terms of Service ("Terms") govern your use of Converix AI's Communications Platform as a Service (CPaaS) and any related services, software, and websites (collectively, the "Service") operated by Converix AI, Inc. ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
We reserve the right to modify these Terms at any time. We will provide notice of material changes to these Terms by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
Acceptance of Terms
By accessing and using Converix AI services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Use License
Permission is granted to temporarily use Converix AI services for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose or for any public display; attempt to reverse engineer any software contained on the website; or remove any copyright or other proprietary notations from the materials.
User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials that you submit, post or display on or via the service.
Prohibited Uses
You may not use Converix AI to: violate any applicable laws or regulations; send spam, unsolicited messages, or engage in any form of harassment; impersonate any person or entity; interfere with or disrupt the service or servers; attempt to gain unauthorized access to any part of the service; use the service to distribute malware, viruses, or other harmful code; or engage in any activity that could damage, disable, overburden, or impair the service.
Service Availability
We strive to maintain high availability of our services but cannot guarantee uninterrupted access. We may suspend or terminate services for maintenance, updates, or other operational reasons. We will provide reasonable notice for planned maintenance when possible.
Limitation of Liability
In no event shall Converix AI or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Converix AI's website, even if Converix AI or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Additional Information
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
Governing Law
These Terms shall be interpreted and governed by the laws of the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes to Service
We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
